We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

You are responsible for the accuracy and legality of all content you upload. We do not verify the accuracy of SDS information and are not liable for any errors or omissions.

5.3 Data Backup

While we maintain backups of your data, you are responsible for maintaining your own backups of important information.

6. Payment Terms

6.1 Subscription Fees

Access to certain features requires a paid subscription. Subscription fees are:

• Charged in advance on a monthly or annual basis
• Non-refundable except as required by law
• Subject to change with 30 days' notice
• Automatically renewed unless cancelled

6.2 Payment Processing

Payments are processed by third-party payment providers. You agree to their terms and conditions.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

8.2 AI Technology

Our AI processing technology is designed to assist with SDS management but may not be 100% accurate. You should verify all critical information independently.

8.3 Third-Party Content

We are not responsible for the accuracy, completeness, or reliability of third-party content, including SDS files from manufacturers.

9. Limitation of Liability

To the maximum extent permitted by law, SAPIENTROQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Service interruptions or security breaches
• Errors in AI processing or data analysis
• Third-party actions or content

Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SAPIENTROQ from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Luzern, Switzerland.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on our website
• Sending email notifications to registered users
• Providing in-app notifications

Continued use of the Service after changes constitutes acceptance of the new Terms.
